The Liquidating Trusts have completed the liquidation of substantially all non-litigation assets. The availability of additional funds for distribution from the Liquidating Trusts depends on ongoing litigation involving the Private Actions Trust (“PAT”) and the Estate Litigation Trust (“LIT”). Due to the uncertainty of litigation, the Liquidating Trusts may not receive sufficient additional proceeds from the PAT and the LIT to make any further distribution. If the Liquidating Trusts receive sufficient additional litigation proceeds from the PAT and/or the LIT to distribute to beneficiaries, then the Liquidating Trusts will make one more (FINAL) Distribution, most likely in late 2017 or during 2018. However, if the Liquidating Trusts do not receive sufficient additional litigation proceeds from the PAT and/or the LIT to distribute to beneficiaries, then you will receive a notice that the most recent distribution (in March 2017 for the DBSI Liquidating Trust, and in April/May 2017 for the DBSI Real Estate Liquidating Trust) was the FINAL Distribution.
