Is My Beneficial Interest Transferable?

Beneficial Interests are not transferable except in limited circumstances as follows (each a “Permissible Transfer”):

  • To a legal guardian or conservator, upon your permanent disability*;

  •  To an executor or administrator under a will or the laws of intestacy*;

  • To a trustee under a will or to your beneficiaries under your will*;

  • To your spouse, children, stepchildren, grandchildren, parents, siblings or legal dependents (“Family Members”);

  • To a trust for the benefit of yourself and/or Family Members;

  • To a partnership comprised of Family Members;

  • In the case of a Beneficial Interest held by a corporation, partnership, limited liability company, trust or other legal entity (an “Entity”), to the owners of its equity interests.

  • To/from or between your own IRA or pension account(s).
